When can I apply for US citizenship?
An EB-5 investor who has been a lawful permanent resident (LPR) for a minimum of 5 years may apply for U.S. citizenship. The 2-year conditional residency period (i.e. having the conditional green card) counts toward the 5-year requirement.
Additionally, to apply for naturalization to become a U.S. citizen, the EB-5 investor must:
- Be at least 18 years of age at the time of filing the application;
- Have continuous residence and physical presence in the United States;
- Be able to read, write, and speak basic English;
- Demonstrate good moral character;
- Demonstrate a knowledge and understanding of U.S. history and government;
- Demonstrate a loyalty to the principles of the U.S. Constitution; and
- Be willing to take the Oath of Allegiance.
Generally, an EB-5 investor intending to obtain U.S. citizenship should not stay outside the U.S. longer than 180 days in any given year without advance consultation with their immigration lawyer.
Satisfying these requirements can be complex and subject to variation depending on individual circumstances. EB-5 investors should consult their immigration lawyer for legal advice.
