What is the EB-5 Application Process?

The EB-5 process comprises of 3 basic stages:

  1. Initiate the EB-5 investment and file the I-526 petition.

     

  2. After I-526 approval, file the I-485 to adjust status or DS-260 for consular processing. Once approved, the 2-year conditional residence period begins.

     

  3. File the I-829 petition to remove conditions any time 90 days before the end of the 2-year conditional residence period.

To get started, the EB-5 investor should do the following:

  • Complete due diligence on a chosen EB-5 project.
  • Fill out the Investor Questionnaire and verify Accredited Investor status.
  • Hire an immigration lawyer.
  • Prepare the source of funds documents.
  • Execute the subscription documents.
  • Transfer investment funds and fees to the EB-5 project.
  • File the the I-526 petition.
