Regulations Take Effect NOVEMBER 21st, 2019

Office of Management and Budget (OMB) has published the finalized new regulation for EB-5. Until the new regulation is implemented on November 21st 2019, current EB-5 program rules remain in effect. In order to invest under the current EB-5 regulatory framework and lock-in the current minimum investment amount of $500,000, you must file an I-526 petition before November 21st, 2019.

TEA Designation is Changing

The new EB-5 regulations give DHS the exclusive authority to designate TEAs, based on a new methodology that would restrict TEA investment to high unemployment cities and towns with populations under 20,000. This will limit the majority of investors from being able to access the most desirable types of  projects: urban development projects.

Minimum Investment Amount is Increasing

The minimum investment amount for EB-5 will increase to $900,000 for TEA projects. However, nearly all high quality EB-5 projects today are located in areas which will no longer be considered TEAs after the new EB-5 regulations take effect; the new investment amount for these projects will be $1,800,000.

Colin Behring is the Founder and CEO of the Behring Companies. Mr. Behring is a third generation San Francisco Bay Area property developer and investor. Mr. Behring's current primary activities include real estate development, investment, and EB-5 financing. Previous to 2013, Mr. Behring previously served various positions within the Behring families property development company Behring Group, Ltd, completing those activities in 2013. Behring has been developing his expertise in international property development and finance since 2006 where he got his professional start with Morgan Stanley Properties, Shanghai as an analyst intern in Shanghai. Mr. Behring graduated from California State Polytechnic University San Luis Obispo with a degree in Business Administration concentrating in Finance. Mr. Behring is proficient in English, Mandarin Chinese and has obtained working proficiency in Portuguese (Brazilian).

Aaron Hammon is the Vice President of Operations for Behring. Mr. Hammon joined the Behring Companies in January 2018 and brings over 12 years of consulting and leadership experience to the Company. Mr. Hammon oversees daily operations which includes real estate development operations, private equity fund administration, investor relations and reporting, corporate financial and legal compliance, and outbound digital platform and sales. Mr. Hammon has leadership experience working with operational teams and clients to streamline success and execute strategic visions. Mr. Hammon has been a Certified Public Accountant since 2007. Mr. Hammon earned his MBA from U.C. Davis Graduate School of Management with an emphasis in strategy & entrepreneurship and a BS in Business Administration with an emphasis in public accounting & finance from Cal Poly, San Luis Obispo.

Peter is an American attorney experienced in real estate, immigration and consumer law. Prior to joining Behring, Peter led the development of new foreign markets for EB-5 capital raises by Related Companies, one of the largest private developers in the US.

Kyle Behring is an Investment Associate with Behring Companies and is responsible for the investment platforms, investment underwriting, investor relations, and capital markets support. Mr. Behring is an expert in EB-5 policy, procedures, and investment-based immigration. Additionally, Mr. Behring is responsible for the management of Behring Companies’ digital marketing platform and data management systems. Kyle Behring graduated with a Bachelors degree in Business Administration with an emphasis in Information Management Systems from the Leeds School of Business at the University of Colorado, Boulder, in 2017.

Greg Sheehan is a licensed immigration attorney and has been working in the field since 2007. He has personal experience with EB-5 filing in private practice and he spent five years at USCIS Headquarters at the Immigrant Investor Program Office. There he was a Union Steward and adjudicated every form type; I-526, I-829, and the former Regional Center Forms I-924. Greg made policy contributions, worked on office wide training and was part of the I-956 roll out team during the Behring Settlement. He received the USCIS Individual Award for Innovation in 2018 and his unique skills are perfectly suited to contribute to the rapid growth of the Behring EB-5 Investor Platform. He is the private sector's closest connection to Post-RIA insights and he excited to service the investor class with the new investments poised for 2023 and beyond.

Christina Ji manages an established capital markets platform throughout the greater China region. Christina previously worked for China Resources Land Limited (HK1109), one of the most influential real estate developers in Mainland China and Hong Kong as well as Related (Shanghai).

Mr. Gao Bei, as the Managing Director of the Asia Pacific region, is responsible for the operation and promotion of the entire Asia Pacific platform. With his deep experience in real estate development and professional background in the financial industry, he participated in multiple domestic and foreign market real estate development projects from 2013 to 2017. He has directly or indirectly participated in and managed a total fund size of over 3 billion RMB, and has rich experience in the development and operation of the real estate industry
