2017 EB-5 Policy Change Update – IIUSA Comments on Notice of Proposed Rulemaking

April 16th, 2017 Colin Behring

IIUSA has responded to USCIS request for comments and they have created a very in-depth analysis of the positive and negative effects of the proposed rule making.

Their comments include analysis on the major hot buttons in EB-5 including:

  1. The EB-5 visa minimum investment amount
  2. The EB-5 project target employment areas (TEA designations)
  3. The EB-5 visa priority date retention capability (due to material changes)
  4. EB-5 visa retrogression
  5. EB-5 investor fraud recovery provisions – relief for defrauded investors and more!
