This reflects a longstanding USCIS principle that remains firmly in place: an EB-5 petition must be “approvable at the time of filing.” In practical terms, this means every eligibility requirement, including your qualifying investment, must be properly structured, documented, and funded in accordance with your investment agreements.

Installment funding remains permissible under EB-5 rules. However, when an investor does not follow the agreed payment schedule or fails to execute required documentation, USCIS may determine that the investment was not properly committed, placing the entire petition at risk.
