What is the Unity Lender?
Behring’s Unity Lender, introduced by Behring Regional Center, was the EB-5 industry’s first licensed lending company designed to provide USCIS-compliant loans for qualified EB-5 investors.
It offers a financing vehicle for alternative investments, addressing the need for flexible source-of-fund models. Historically, many EB-5 investors sought ways to meet investment requirements, and the U.S. Court of Appeals’ ruling on October 27, 2020, confirmed that loan proceeds are equivalent to cash. This breakthrough gave EB-5 investors access to traditional debt financing. However, with the increase in minimum investment requirements to $800,000 for TEA (Targeted Employment Area) projects, raising capital became more challenging, even with the option of partial capital contributions.
Confirmation of USCIS compliance.
KLDP LLP, a key partner in the Behring ecosystem, has been instrumental in helping EB-5 petitioners worldwide achieve success in their green card applications. Their Mandamus efforts, which expedited processing times for a group of 18 Behring investors, have validated our innovative financial tools, like the Unity Lender, partial capital contributions, and Self-Directed IRA rollovers. The recent wave of fast approvals confirms compliance with USCIS standards, putting to rest any doubts about these funding strategies.
The New Normal in EB-5 Financing.
Thanks to the collaborative efforts of KLDP and Behring Regional Center, EB-5 investors now have access to groundbreaking financial strategies that have been validated by the Immigrant Investor Program Office. These innovative approaches, once questioned, are now recognized as compliant with EB-5 regulations, shaping a new standard in the industry.
A Huge Moment for KLDP and Behring Regional Center.
Many, many thanks to Niral Patel and Hallie Schechter of KLDP LLP who are seeing these October approvals, only one month after a September Writ of Mandamus filing.
From a Regional Center point of view, Phuong Le’s work on our various project filings and Writ of Mandamus actions accelerated I-956F confirmation that our muti-asset, cash flowing RISE fund with various investment options meets the program requirements.
