Behring’s San Jose Student Housing EB-5 Project, The Grad, Obtains USCIS Exemplar Approval

Behring Regional Center is pleased to announce that the exemplar Form I-924 and I526 exemplar application for The Graduate EB-5 Project was approved by USCIS on April 27, 2021. The project was approved directly by USCIS, with no RFE or challenge from USCIS. The project’s construction is already completed, EB-5 job creation satisfied and student housing units successfully leasing up.  Although more than a dozen actual I-526 investor petitions have already been approved, having the exemplar approval from USCIS provides an even greater certainty and deference to those EB-5 investors awaiting approval for their pending I-526 petitions. 

USCIS Acknowledges Behring Regional Center Name Change 

In addition to approving The Grad Project’s exemplar I-924 application, USCIS also acknowledged Behring Regional Center’s name change. Behring Regional Center, formerly known as Berkeley Regional Center Fund LLC, ID1316551161, officially changed in 2019 to simplify and align branding across Behring’s real estate development, investment and EB-5 regional center operations. USCIS acknowledgement helps to clear any potential confusion among prospective EB-5 investors.   

Behring’s Winning Streak Continues  

The approval of The Grads I-924 and I-526 exemplar petition is a new milestone as it was the first rescue projectengaged by Behring. Initially, the project was sponsored by a separate third-party “rent-a-center,” i.e., a rented regional center, that failed to establish an offering, failed to attract any investment and abandoned the project with no viable path forward. Behring stepped in, cured the deficiencies and subscribed over 57 investors in record time. The I-924 petition was approved with no RFE and no challenge from USCIS. This is a testament to the quality of work, clear and concise documentation and attention to detail provided by Behring on behalf of EB-5 investors.  

Behring’s 1900 Broadway is TEA-eligible and I-924 and I-526 Approved 

While The Grad is already successfully completed and closed for new EB-5 investors, Behring’s flagship property, 1900 Broadway, is currently open. 1900 Broadway is a 39-story, 452-unit multifamily apartment tower directly adjacent to the 19th Street/Uptown BART in downtown Oakland, California. Construction is currently underway, and more than one-third of necessary job creation has been achieved. See more details here.
